Antitrust exemption for major league baseball -
City of San Jose v. Office of the Cmm’r of Baseball, 776 F.3d 686 (9th Cir. 2015). An action against Major League Baseball to allow the Oakland A’s to move to San Jose. A die-hard baseball fan, Phil served as co-lead counsel, arguing at the district court and in the Ninth Circuit.
Class action for pension fund violations -
Neil, et al. v. Zell, 677 F.Supp.2d 1010 (N.D. Ill. 2010) Phil served as co-lead counsel in a class action over the defendants’ acquisition of national media company for pension fund violations.
Environmental litigation on long-standing groundwater contamination -
Cotchett, Pitre & McCarthy v. Universal Paragon Corp., 187 Cal.App.4th 1405 (2010). Phil acted as lead counsel of environmental litigation relating to decades-long groundwater contamination.
Youth climate change litigation -
Juliana v. United States, 947 F.3d 1159 (9th Cir. 2020), petition for rehearing en banc filed (9th Cir. Mar. 3, 2020) (No. 18-36082); In re United States, 895 F.3d 1101 (9th Cir. 2018); and In re United States, 884 F.3d 830 (9th Cir. 2018). As co-lead counsel, Phil represents 21 young plaintiffs who assert the U.S. government, through its affirmative actions in creating a national energy system that causes climate change, is depriving them of their constitutional rights to life, liberty, and property, and has failed to protect essential public trust resources.
Saving old-growth redwoods -
Bair, et al. v. Cal. State Dep't of Transp. (N.D. Cal. 2012) 867 F.Supp.2d 1058; Lotus, et al. v. Department of Transportation, et al. (2014) 223 Cal.App.4th 645. Phil serves as co-lead counsel in federal and state actions against CalTrans to save old growth redwoods in Richardson Grove State Park.
