Climate change

Phil Gregory serves as co-lead counsel in an action by 21 youth against agencies of the federal government to address human-made climate change caused by the fossil fuel-based energy system, Juliana, et al. v. United States, et al. (District of Oregon).

Environmental litigation

Phil acted as lead counsel on environmental litigation relating to decades-long groundwater contamination. The California Court of Appeal described Phil’s handling of this groundwater contamination suit as obtaining “a ‘stupendous’ result for the [client].” Phil was one of the trial counsel against the Army Corps of Engineers for the flooding of the Lower Ninth Ward during Hurricane Katrina (Eastern District of Louisiana); was part of the team obtaining a preliminary injunction against CalTrans and NMFS to save the cohoo salmon in the Smith River; and successfully obtained an injunction in an action against PacifiCorp, Inc. to save salmon in the Klamath River.

Complex Business Matters

Phil has been lead or co-lead counsel in numerous complex business/commercial matters. Some examples: actions on trade secret theft, including obtaining what was then one of the largest trade secret jury trial verdicts in Silicon Valley history; antitrust litigation related to semiconductor memory technology; securities arbitration against an investment bank; settlement of a stock option backdating case; defense and settlement of an international dispute concerning the rights to CMOS semiconductor technology; prosecution of a $17 million employee embezzlement scheme and defending related actions by three banks to recover funds lent pursuant to forged documents; patent, copyright, and trademark infringement claims.

Employment & Real Estate

Phil’s practice includes employment and real property matters. Some of Phil’s representative cases include: trial over ownership rights to a World War II German Panzer IV Tank; litigation over acquisition of several businesses in Silicon Valley; disputes involving founders of high tech companies; internal investigations for sexual and racial discrimination; and trials involving title for numerous acres of real property in the Santa Cruz Mountains and in Half Moon Bay.
